Terms of Service

1. Introduction

Welcome to Jacob Moyo Painting and Decorations (Pty) Ltd (Registration Number: 2020/213040/07). These Terms of Service ("Terms") govern your use of our painting, decoration, and construction services.

By engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Offered

We provide the following professional services:

  • Interior and exterior painting for residential and commercial properties
  • Roof painting and protective coating application
  • Waterproofing solutions for roofs, basements, and bathrooms
  • Tiling and plastering services
  • General construction and renovation work

3. Quotations and Pricing

3.1 Free Quotations: We provide free, no-obligation quotations for all services. Quotations are valid for 30 days from the date of issue unless otherwise stated.

3.2 Accuracy: While we strive for accuracy, quotations are estimates based on the information provided and site inspection. Final costs may vary if additional work is discovered or if the scope changes.

3.3 Acceptance: Quotations become binding upon your written or electronic acceptance and payment of any required deposit.

3.4 Additional Work: Any work beyond the original scope will be quoted separately and requires your approval before commencement.

4. Payment Terms

4.1 Deposit: A deposit of up to 50% may be required before work commences, depending on the project size and materials needed.

4.2 Progress Payments: For larger projects, payment milestones will be agreed upon in writing and due upon completion of each phase.

4.3 Final Payment: Final payment is due upon satisfactory completion and your approval of the work, unless otherwise agreed in writing.

4.4 Methods: We accept cash, bank transfer (EFT), and card payments. Payment details will be provided on your invoice.

4.5 Late Payment: Late payments may incur interest at the prescribed legal rate and may result in suspension of work until payment is received.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about the property and project requirements
  • Ensure access to the work site during agreed-upon hours
  • Remove or protect valuable items and furnishings from the work area
  • Notify us promptly of any concerns or issues during the project
  • Obtain any necessary permissions or approvals from property owners, body corporates, or local authorities
  • Make timely payments according to the agreed schedule

6. Warranties and Guarantees

6.1 Workmanship: We guarantee our workmanship for a period specified in your written agreement, typically ranging from 6 months to 2 years depending on the service.

6.2 Materials: Material warranties are subject to manufacturer guarantees. We use premium quality materials from reputable suppliers.

6.3 Exclusions: Warranties do not cover damage caused by normal wear and tear, negligence, improper maintenance, natural disasters, or alterations made by third parties.

6.4 Claims: Warranty claims must be reported in writing within 7 days of discovering the issue. We will assess and remedy valid claims at no additional cost.

7. Cancellation and Changes

7.1 Client Cancellation: You may cancel before work commences with written notice. Deposits may be refunded minus any costs already incurred (materials ordered, site visits, etc.).

7.2 Cancellation After Commencement: If you cancel after work has started, you will be charged for all work completed and materials purchased to date.

7.3 Changes to Scope: Any changes to the agreed scope of work must be requested in writing and may result in price adjustments and timeline changes.

7.4 Our Cancellation Right: We reserve the right to cancel if you fail to provide access, make payments, or if we discover safety hazards or structural issues that prevent safe work.

8. Limitation of Liability

8.1 Insurance: We maintain comprehensive public liability insurance and workers' compensation insurance as required by South African law.

8.2 Property Damage: While we take utmost care, we are not liable for damage to hidden defects, pre-existing conditions, or items not moved from the work area as requested.

8.3 Indirect Damages: We are not liable for indirect, consequential, or special damages including loss of use, loss of profits, or inconvenience.

8.4 Maximum Liability: Our total liability is limited to the amount paid for the specific service in question, except where prohibited by law.

9. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, strikes, government actions, pandemics, material shortages, or other unforeseeable events. We will notify you promptly of any such delays and work to resume services as soon as reasonably possible.

10. Dispute Resolution

10.1 Good Faith Negotiation: In the event of any dispute, both parties agree to first attempt to resolve the matter through good faith negotiation.

10.2 Mediation: If negotiation fails, disputes will be submitted to mediation before pursuing legal action.

10.3 Jurisdiction: These Terms are governed by the laws of South Africa. Any legal proceedings will be subject to the exclusive jurisdiction of the South African courts.

11. Intellectual Property

All designs, plans, and concepts created by us remain our intellectual property until full payment is received. We reserve the right to photograph completed projects for marketing purposes unless you object in writing. We will not disclose your address or personal information without your consent.

12. Privacy and Data Protection

We are committed to protecting your privacy and complying with the Protection of Personal Information Act (POPIA). We collect and use your personal information solely for providing our services and as described in our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. For ongoing projects, the Terms in effect at the time of your agreement will apply.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original.

15. Entire Agreement

These Terms, together with any written quotation or agreement, constitute the entire agreement between you and Jacob Moyo Painting and Decorations (Pty) Ltd regarding our services. They supersede all prior discussions, negotiations, and agreements.
